Pratica - Workplace Training Program

Effective Date: 30.06.2026

These Terms and Conditions ("Terms") constitute a legally binding agreement between Pratica ("Pratica ", "we", "our" or "us") and the individual enrolling in or participating in the Pratica - Workplace Training Program ("Participant", "you" or "your").

By submitting an enrolment application, accepting these Terms electronically, making payment of any Program fees, or participating in any part of the Program, you acknowledge that you have read, understood and agree to be legally bound by these Terms.

Where enrolment is completed electronically, the parties agree that acceptance of these Terms by electronic means constitutes acceptance for the purposes of the Electronic Transactions Act 2000 (NSW) and any other applicable legislation governing electronic communications and transactions.

These Terms should be read together with our Privacy Policy, Refund Policy, Website Terms of Use (where applicable), and any Program Information provided prior to enrolment. To the extent of any inconsistency, these Terms prevail unless otherwise expressly stated.


Part 1. Definitions and Interpretation

1.1 Definitions

In these Terms, unless the context otherwise requires:

Australian Consumer Law means Schedule 2 of the Competition and Consumer Act 2010 (Cth), as amended from time to time.

Business Day means a day other than a Sunday or public holiday in New South Wales.

Confidential Information includes all non-public information disclosed during the Program, including but not limited to architectural drawings, project documentation, design methodologies, workflows, quality assurance procedures, checklists, templates, consultant coordination methods, recorded sessions, teaching resources, business processes, commercial information and any information that would reasonably be regarded as confidential.

Course Materials or Training Materials means all materials supplied, created or made available by Pratica in connection with the Program, whether in, but not limited to printed, digital, verbal or recorded form, including presentations, videos, manuals, architectural drawings, BIM models, Revit families, CAD templates, project examples, schedules, specifications, checklists, workflows, templates, assessments, recordings and downloadable resources.

Mentor means any director, trainer, instructor, consultant, guest presenter or authorised representative engaged by Pratica to deliver any part of the Program.

Participant means the person enrolled in the Program.

Program means the Pratica - Workplace Training Program and includes all workshops, mentoring sessions, online learning, recordings, resources, assessments, discussion forums, project exercises and related services provided by Pratica.

Website means Pratica's website and any associated online learning portal used for the delivery of the Program.


1.2 Interpretation

Unless the context otherwise requires:

(a) headings are included for convenience only and do not affect interpretation;

(b) words importing the singular include the plural and vice versa;

(c) references to legislation include amendments, replacements and subordinate legislation made under that legislation;

(d) references to a person include an individual, company, partnership, trust or other legal entity;

(e) the words "including", "includes" and "such as" are not words of limitation.


2. About the Program

Pratica - Workplace Training Program has been developed to bridge the gap between higher education and professional architectural practice by providing practical, industry-focused training delivered by experienced design practitioners.

The Program is intended to assist design and architectural students, recent graduates, allied construction graduates and aspiring industry professionals in developing the practical knowledge, technical capability and workplace understanding commonly expected within Australian design/architectural practices.

 

Training may include, but is not limited to:

  • architectural design workflows;

  • Development Application (DA) documentation;

  • Complying Development Certificate (CDC) documentation;

  • Construction Certificate (CC) documentation;

  • construction documentation;

  • consultant coordination;

  • architectural detailing;

  • Building Information Modelling (BIM);

  • documentation reviews;

  • workplace simulations;

  • mentoring sessions;

  • portfolio guidance; and

  • industry discussions.

The Program has been designed as a professional development initiative and is intended to complement, rather than replace, formal tertiary education and workplace experience.

Unless expressly stated otherwise, the Program is NOT:

  • an accredited qualification;

  • vocational education or training provided by a Registered Training Organisation (RTO);

  • a university degree;

  • employment;

  • an internship;

  • supervised practical experience recognised for architectural registration; or

  • professional architectural advice.

Nothing in the Program should be interpreted as creating an employment relationship, partnership, agency or joint venture between Pratica and any Participant.


3. Acceptance of these Terms

By enrolling in the Program, you acknowledge and agree that:

(a) you have had a reasonable opportunity to read these Terms prior to enrolment;

(b) you understand the nature and purpose of the Program;

(c) you have relied upon your own judgement when deciding to enrol;

(d) you agree to comply with these Terms throughout your participation in the Program;

(e) you understand that participation in the Program is subject to these Terms, our published policies and any lawful directions provided by Pratica or its Mentors.

If you do not agree with these Terms, you must not enrol in or participate in the Program.


4. Eligibility for Enrolment

The Program is intended for individuals who wish to develop practical design architectural workplace skills, including:

  • architecture students;4recent architecture graduates;

  • design graduates seeking to improve their employment readiness;

  • individuals transitioning into architectural practice; and

  • other allied persons within construction industry approved by Pratica.

Participants are responsible for ensuring that they possess sufficient foundational architectural knowledge to meaningfully participate in the Program.

Pratica may publish recommended prerequisites for particular modules or workshops. Participants acknowledge that successful completion of the Program may depend upon their existing knowledge, commitment, participation and willingness to undertake independent study.

Pratica reserves the right to refuse, decline or cancel an enrolment where, acting reasonably, it considers that:

(a) the Program is not suitable for the applicant;

(b) the applicant does not satisfy published prerequisites;

(c) enrolment capacity has been reached;

(d) acceptance of the enrolment may adversely affect the learning environment for other Participants; or

(e) any information provided during the enrolment process is materially inaccurate or incomplete.

Where an enrolment is declined before the commencement of the Program, any fees paid will be refunded in accordance with Pratica's Refund Policy and the Australian Consumer Law.


5. Enrolment Process

An enrolment is not accepted until Pratica has confirmed acceptance in writing.

Submission of an application or payment of Program fees does not, of itself, guarantee a place within the Program.

Pratica may request additional information where reasonably necessary to assess an application.

Upon acceptance of an enrolment, the Participant will receive confirmation together with details regarding Program commencement, access to learning resources and any relevant administrative information.

Participants are responsible for ensuring that all information provided during enrolment remains accurate and up to date, including contact details, email addresses and payment information.

Pratica may communicate with Participants electronically, including by email, online learning platforms and other digital communication systems. Participants consent to receiving notices, invoices, updates and other communications by electronic means.


6. Participant Responsibilities Prior to Commencement

Participants acknowledge that successful participation in the Program requires preparation and personal commitment.

Prior to commencement, Participants are responsible for:

(a) ensuring they have access to suitable computer hardware and a reliable internet connection where online delivery is involved;

(b) obtaining any software identified by Pratica as a participant requirement, unless expressly stated otherwise;

(c) reviewing any pre-course information provided by Pratica;

(d) ensuring they are able to attend scheduled sessions or otherwise meet participation requirements; and

(e) familiarising themselves with these Terms and any policies referenced within them.

Failure to satisfy these requirements does not relieve a Participant of their obligations under these Terms.


7. Program Delivery

Pratica will deliver the Program using such methods, formats and learning activities as it considers appropriate to achieve the educational objectives of the Program.

The Program may be delivered through one or more of the following methods:

  • live online workshops;

  • in-person workshops or studio sessions;

  • one-to-one mentoring sessions;

  • group mentoring sessions;

  • recorded training modules;

  • practical drawing and documentation exercises;

  • workplace simulation activities;

  • project reviews;

  • portfolio reviews;

  • question and answer sessions;

  • downloadable learning resources; and

  • other learning activities as determined by Pratica.

Pratica reserves the right to determine the structure, sequence, duration and method of delivery of all Program content.

While reasonable efforts will be made to deliver the Program in accordance with published schedules, Pratica may modify, substitute, postpone or reschedule any session where reasonably necessary due to operational requirements, availability of Mentors, technological issues, participant numbers, legislative changes or circumstances beyond Pratica's reasonable control.

Where reasonably practicable, Participants will be notified of any significant changes.

Pratica may appoint additional trainers, guest presenters or industry professionals to deliver specific modules or specialist content.

Nothing in these Terms guarantees that any particular Mentor, presenter or instructor will deliver a specific session.


8. Educational Purpose of the Program

The Program has been developed to assist Participants in developing practical workplace knowledge commonly expected within Australian design practices.

The Program is intended to complement academic study by exposing Participants to professional workflows, documentation methodologies and industry practices through structured learning and mentoring.

Pratica makes reasonable efforts to ensure that information presented throughout the Program reflects current industry knowledge and accepted professional practice at the time of delivery.

However, architecture is a profession that is subject to continual changes in legislation, planning controls, government policies, the National Construction Code, Australian Standards, local council requirements, software platforms and industry practices.

Accordingly, Participants acknowledge and agree that:

(a) the Program is educational in nature;

(b) examples used throughout the Program are intended to demonstrate learning outcomes and professional methodologies;

(c) information presented during the Program may require modification to suit individual project circumstances;

(d) Participants remain responsible for verifying all information before applying it within professional practice; and

(e) no representation is made that any example, drawing or workflow is suitable for every project or regulatory authority.

Pratica does not warrant that completion of the Program alone will enable a Participant to competently perform every aspect of architectural practice without further professional supervision and practical experience.


9. Workplace Simulation

A distinguishing feature of the Program is the use of workplace simulation to provide Participants with exposure to processes commonly undertaken within Australian design practices.

Workplace simulations are designed to assist Participants in understanding how architectural projects are typically developed from project commencement through to documentation and consultant coordination.

Simulation exercises may include, without limitation:

  • client brief interpretation;

  • site analysis;

  • concept design;

  • design development;

  • Development Application (DA) documentation;

  • Complying Development Certificate (CDC) documentation;

  • Construction Certificate (CC) documentation;

  • construction documentation;

  • consultant coordination;

  • preparation of schedules;

  • detailing;

  • quality assurance procedures;

  • documentation review;

  • drawing mark-ups;

  • office workflows; and

  • project communication.

Participants acknowledge that these exercises are educational simulations only.

Unless expressly stated otherwise, simulation exercises do not constitute complete construction documentation, statutory approval documentation or professional advice suitable for use on live projects.

Pratica accepts no responsibility for any reliance placed upon simulated exercises outside the educational context of the Program.


10. Professional Judgement and Participant Responsibility

Pratica encourages Participants to develop independent professional judgement as an essential component of architectural practice.

Participants acknowledge that architectural design and documentation require the consideration of numerous project-specific factors, including but not limited to:

  • planning controls;

  • client requirements;

  • consultant advice;

  • engineering input;

  • geotechnical conditions;

  • environmental considerations;

  • accessibility requirements;

  • building regulations;

  • construction methods; and

  • applicable legislation.

Accordingly, Participants remain solely responsible for independently assessing the suitability, accuracy and compliance of any information obtained through the Program before applying that knowledge within professional practice.

Nothing presented throughout the Program should be interpreted as replacing professional advice or statutory requirements applicable to individual projects.


11. National Construction Code, Legislation and Australian Standards

Throughout the Program, reference may be made to legislation, regulations, planning instruments, Australian Standards, technical publications, design guides and the National Construction Code ("NCC") for educational purposes.

Pratica makes reasonable efforts to present information that reflects current legislative and industry requirements at the time the relevant module is delivered.

However, Participants acknowledge that:

(a) legislation and regulations are subject to amendment;

(b) planning controls differ between jurisdictions;

(c) local councils may impose project-specific requirements;

(d) Australian Standards are periodically revised;

(e) the NCC is updated from time to time; and

(f) statutory approval requirements vary depending upon project location and circumstances.

Participants remain responsible for ensuring they refer to the most current legislation, NCC provisions, Australian Standards and applicable planning controls before applying any knowledge obtained through the Program.

Nothing in the Program should be interpreted as legal, planning, certification, engineering or professional advice.


12. Learning Outcomes

Pratica is committed to providing high-quality industry-focused education and mentoring.

Individual learning outcomes, however, are influenced by numerous factors beyond Pratica's control, including:

  • prior knowledge;

  • academic background;

  • attendance;

  • participation;

  • independent study;

  • practice undertaken outside scheduled sessions;

  • communication skills;

  • personal commitment; and

  • technical aptitude.

Accordingly, Pratica does not warrant or guarantee that every Participant will achieve identical levels of competency or progress within a particular timeframe.

Participants acknowledge that professional competence is developed progressively through ongoing education, workplace experience and continual learning.


13. Employment and Career Outcomes

The primary objective of the Program is to improve Participants' practical understanding of architectural practice and assist them in becoming more competitive candidates for employment within the design and construction industry.

While Pratica endeavours to provide practical, industry-relevant training and mentoring, participation in or completion of the Program does not constitute a guarantee of:

  • employment;

  • internship opportunities;

  • interviews;

  • salary outcomes;

  • career progression;

  • migration outcomes;

  • professional registration; or

  • any other specific employment-related outcome.

Employment decisions remain the responsibility of individual employers and are influenced by numerous factors outside Pratica's control, including market conditions, available positions, experience, communication skills, portfolio quality and interview performance.

Participants acknowledge that no statement made by Pratica, its directors, employees or Mentors should be interpreted as a promise or guarantee of future employment.

Nothing in Pratica's promotional material should be construed as making representations inconsistent with the Australian Consumer Law, including sections relating to misleading or deceptive conduct or false representations.


14. Program Changes

Pratica continually reviews and updates the Program to reflect changes in industry practice, legislation, software platforms and educational methodology.

Accordingly, Pratica reserves the right to:

(a) modify learning materials;

(b) revise course content;

(c) introduce new modules;

(d) discontinue outdated content;

(e) amend delivery methods;

(f) substitute case studies;

(g) revise practical exercises;

(h) appoint alternative Mentors; or

(i) alter the sequencing of Program content,

provided that such changes are made in good faith and are reasonably directed towards maintaining or improving the quality and relevance of the Program.

Such changes do not constitute a breach of these Terms and do not give rise to any entitlement to a refund or compensation solely because Program content has evolved.


15. Technical Requirements

Participants are responsible for ensuring that they have access to suitable equipment necessary to participate in the Program.

Unless otherwise stated by Pratica, Participants are responsible for providing their own:

  • computer hardware;

  • internet connection;

  • webcam and microphone where required;

  • software licences;

  • operating system updates; and

  • compatible digital devices.

Pratica is not responsible for interruptions to participation resulting from a Participant's equipment, internet service provider, software compatibility or other technical issues beyond Pratica's reasonable control.

Where third-party software is demonstrated during the Program, Participants acknowledge that such software remains subject to the licensing terms and conditions of the respective software developer.

Pratica accepts no responsibility for software licensing arrangements between Participants and third-party software providers.


PART 2 – FEES, PAYMENTS, CANCELLATIONS AND CONSUMER RIGHTS


16. Program Fees

The fees payable for the Program ("Program Fees") are those published on Pratica's Website, enrolment materials or otherwise advised to the Participant at the time of enrolment.

Unless expressly stated otherwise:

(a) all fees are quoted in Australian Dollars (AUD);

(b) fees are payable in accordance with the payment option selected by the Participant and accepted by Pratica;

(c) the Program Fee covers only those services and resources expressly described in the published Program information.

Pratica reserves the right to amend its pricing for future enrolments at any time. Any change in pricing will not affect Participants whose enrolment has already been accepted, unless the Participant subsequently transfers to another intake or purchases additional services.

Pratica is under no obligation to accept an enrolment until payment arrangements satisfactory to Pratica have been made.


17. Deposits

Where Pratica requires payment of a deposit to secure a place within the Program, the Participant acknowledges that:

(a) the deposit reserves a position in a limited-capacity mentoring program;

(b) Pratica may decline other enrolments in reliance upon the Participant's reservation;

(c) unless otherwise required under the Australian Consumer Law or expressly stated in writing, deposits are non-transferable and subject to Pratica's Refund Policy.

If the Participant fails to complete the enrolment process within the timeframe specified by Pratica, the reserved position may be released to another applicant.


18. Payment Plans

Pratica may, at its absolute discretion, offer payment plans for eligible Participants.

Where a payment plan is approved:

(a) the Participant remains liable for payment of the full Program Fee;

(b) instalments must be paid on or before the agreed due dates;

(c) failure to make a payment when due may result in suspension of access to the Program until outstanding amounts are paid;

(d) continued participation in the Program does not waive Pratica's right to recover overdue amounts.

Pratica reserves the right to charge reasonable administrative costs associated with failed payment transactions where permitted by law and where disclosed prior to enrolment.

Where a payment plan is cancelled due to non-payment, any outstanding balance immediately becomes due and payable unless otherwise agreed in writing.

 

19. GST

Unless otherwise stated, all Program Fees are inclusive of Goods and Services Tax (GST) where GST is applicable under the A New Tax System (Goods and Services Tax) Act 1999 (Cth).

Where an amount payable under these Terms is expressed as being exclusive of GST, the Participant must also pay any applicable GST at the same time as the underlying amount becomes payable.

Pratica will issue tax invoices where required by law.


20. Participant Cancellations

A Participant may cancel their enrolment by providing written notice to Pratica.

The effective date of cancellation will be the date upon which written notice is received by Pratica.

The Participant acknowledges that Pratica incurs administrative costs, scheduling commitments and resource allocation upon acceptance of an enrolment.

Accordingly, cancellation requests are subject to Pratica's Refund Policy and any rights available under the Australian Consumer Law.

Failure to attend scheduled sessions, discontinuing participation or choosing not to complete the Program does not, of itself, constitute cancellation or automatically entitle the Participant to a refund.


21. Cooling-Off Period

Where Pratica offers a voluntary cooling-off period (3-7 days), details of that period will be published on Pratica's Website or enrolment materials.

Unless otherwise stated in writing:

(a) a Participant who cancels within the published cooling-off period may be eligible for a refund in accordance with Pratica's Refund Policy;

(b) the cooling-off period ceases immediately upon the Participant accessing a substantial portion of the Program's digital learning materials, recorded sessions or downloadable resources, unless otherwise required by law.

Nothing in this clause limits or excludes any rights available to a Participant under the Australian Consumer Law.


22. Refund Policy

Pratica aims to deal with refund requests fairly, reasonably and in accordance with applicable legislation.

Subject to the Australian Consumer Law, refunds will generally not be available where:

(a) the Participant changes their mind after the applicable cooling-off period has expired;

(b) the Participant decides the Program is no longer suitable for their personal circumstances;

(c) the Participant obtains employment during the Program;

(d) the Participant is unable to attend scheduled sessions due to work, study, travel or personal commitments;

(e) the Participant fails to complete the Program;

(f) the Participant is removed from the Program as a consequence of breaching these Terms.

Refund requests arising from exceptional circumstances will be considered on a case-by-case basis.

Any approved refund may be reduced to account for:

  • administrative costs reasonably incurred;

  • learning materials already supplied;

  • mentoring sessions already delivered;

  • Program access already provided;

  • any other benefits already received by the Participant.

Refunds, where approved, will be processed using the original payment method wherever reasonably practicable.


23. Cancellation or Postponement by Pratica

Pratica reserves the right to postpone, reschedule or cancel the Program where reasonably necessary due to circumstances including:

(a) insufficient enrolment numbers;

(b) illness or unavailability of key Mentors;

(c) technical failures beyond Pratica's reasonable control;

(d) venue availability;

(e) emergency situations;

(f) changes in applicable legislation or regulatory requirements; or

(g) any other circumstance that makes delivery of the Program impracticable.

Where Pratica cancels a Program prior to commencement and is unable to provide a reasonable alternative, Participants will be offered either:

(a) a transfer to a future intake;

(b) a credit towards another Program; or

(c) a refund of fees paid for the cancelled Program,

subject to the Participant's rights under the Australian Consumer Law.

Pratica will not be liable for consequential expenses incurred by Participants, including travel costs, accommodation, loss of income or similar expenses, except where liability cannot lawfully be excluded.


24. Australian Consumer Law

Nothing contained in these Terms is intended to exclude, restrict or modify any consumer guarantee, statutory right or remedy that cannot lawfully be excluded under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law.

Where the Australian Consumer Law applies, Participants may be entitled to certain remedies if the services supplied by Pratica fail to comply with consumer guarantees.

Where permitted by law, and where services are not ordinarily acquired for personal, domestic or household use or consumption, Pratica's liability for breach of a consumer guarantee is limited, at Pratica's election, to:

(a) supplying the services again; or

(b) paying the reasonable cost of having the services supplied again.

Nothing in these Terms limits any remedy that cannot lawfully be excluded under applicable legislation.


25. Promotional Offers and Discounts

From time to time, Pratica may offer promotional pricing, early-bird discounts or other special offers.

Unless otherwise expressly stated:

(a) promotional offers cannot be combined;

(b) discounts cannot be applied retrospectively after enrolment;

(c) promotional offers are available only during the published promotional period;

Pratica reserves the right to withdraw promotional offers at any time prior to acceptance of an enrolment.


26. Failure to Pay

Where any amount payable under these Terms remains overdue, Pratica may, after providing reasonable notice to the Participant:

(a) suspend access to online learning materials;

(b) suspend attendance at mentoring sessions;

(c) withhold feedback on submitted work;

(d) withhold any Statement of Completion or statement of participation;

(e) recover any outstanding amounts through lawful debt recovery processes.

Pratica will act reasonably in exercising these rights and may enter into alternative payment arrangements where appropriate.


27. Statement of Completion

Where Pratica offers a Statement of Completion or similar recognition, issuance of that certificate is conditional upon the Participant:

(a) satisfying the published participation requirements;

(b) complying with these Terms;

(c) paying all Program Fees in full; and

(d) completing any mandatory Program requirements specified by Pratica.

Pratica reserves the right to decline to issue a certificate where these requirements have not been met.

For the avoidance of doubt, any Statement of Completion issued by Pratica recognises participation in the Program only and does not constitute an academic qualification, vocational qualification, professional licence or registration for the purposes of Australian law.


PART 3– INTELLECTUAL PROPERTY, CONFIDENTIALITY AND USE OF PROGRAM MATERIALS


28. Ownership of Intellectual Property

The Participant acknowledges and agrees that all intellectual property rights in the Program and all Training Materials remain the exclusive property of Pratica or its respective licensors unless expressly stated otherwise.

Nothing contained in these Terms transfers ownership of any intellectual property rights to the Participant.

The Participant is granted only a limited licence to access and use the Training Materials strictly in accordance with these Terms.

Without limitation, Pratica's intellectual property includes:

(a) architectural drawings;

(b) design concepts and design methodologies;

(c) workplace workflows and office procedures;

(d) Development Application (DA) documentation;

(e) Complying Development Certificate (CDC) documentation;

(f) Construction Certificate (CC) documentation;

(g) construction documentation;

(h) BIM models;

(i) Revit families;

(j) AutoCAD templates;

(k) title blocks;

(l) drawing standards;

(m) specifications;

(n) schedules;

(o) construction details;

(p) standard details;

(q) quality assurance procedures;

(r) quality control procedures;

(s) consultant coordination methodologies;

(t) project management systems;

(u) templates;

(v) checklists;

(w) videos;

(x) recorded mentoring sessions;

(y) presentations;

(z) manuals;

(aa) digital resources;

(bb) downloadable content;

(cc) assessments;

(dd) exercises;

(ee) case studies;

(ff) graphics;

(gg) photographs;

(hh) branding;

(ii) logos;

(jj) website content;

(kk) teaching methods; and

(ll) all other material developed or supplied by Pratica.

All such material is protected under the Copyright Act 1968 (Cth) and other applicable intellectual property laws.


29. Licence to Use Training Materials

Subject to compliance with these Terms, Pratica grants the Participant a limited, personal, non-exclusive, non-transferable and revocable licence to access and use the Training Materials solely for the Participant's own educational purposes.

This licence:

(a) does not permit commercial use;

(b) may not be assigned or transferred;

(c) automatically terminates upon termination of the Participant's enrolment; and

(d) may be revoked where the Participant breaches these Terms.

Except to the extent permitted by law, Participants must NOT:

(a) reproduce;

(b) copy;

(c) modify;

(d) adapt;

(e) translate;

(f) reverse engineer;

(g) distribute;

(h) publish;

(i) upload;

(j) communicate;

(k) licence;

(l) sell;

(m) rent;

(n) commercially exploit; or

(o) otherwise make available,

any Training Materials without Pratica's prior written consent.


30. Restrictions on Sharing Program Materials

Participants acknowledge that the Program has been developed through substantial professional experience, investment and industry knowledge.

Accordingly, Participants must not, without Pratica's prior written consent:

(a) provide Program materials to another person;

(b) permit another person to access the Program using their login credentials;

(c) upload Program resources to cloud storage for public sharing;

(d) post Program materials on social media;

(e) distribute recordings of mentoring sessions;

(f) reproduce templates for commercial purposes;

(g) incorporate substantial portions of Pratica's materials into another training course;

(h) use Program materials to establish or promote a competing education or mentoring business;

(i) use Program materials for commercial architectural consulting services; or

(j) remove copyright notices, branding or proprietary markings from any Program material.

Pratica reserves all rights not expressly granted under these Terms.


31. Recording of Sessions

Pratica will NOT record workshops, mentoring sessions or presentations.

Any recording produced by Pratica remains the exclusive property of Pratica.

Participants must NOT:

(a) make their own audio or video recordings of any Program session;

(b) screen record online workshops;

(c) photograph confidential presentation slides;

(d) reproduce recordings;

(e) upload recordings to any website or online platform;

(f) distribute recordings to any third party; or

(g) use recordings for commercial purposes.

Any unauthorised recording or distribution may constitute an infringement of Pratica's copyright under the Copyright Act 1968 (Cth) and may result in immediate termination of the Participant's enrolment.


32. Participant Work and Portfolio Use

Pratica acknowledges that practical project work forms an important component of a Participant's professional portfolio.

Subject to this clause, Participants retain ownership of original work they independently create during the Program.

However, where a Participant's work incorporates or is derived from Pratica's Training Materials, intellectual property, templates or proprietary methodologies, ownership of those underlying materials remains with Pratica.

Participants may include completed exercises within their personal employment portfolio provided that:

(a) the work is used solely for obtaining employment or demonstrating personal capability;

(b) confidential project information has been removed;

(c) proprietary templates are not redistributed;

(d) Company branding is not removed from materials where such branding forms part of the original document;

(e) the work is not sold or licensed; and

(f) the Participant does not represent Pratica's proprietary documentation systems as their own original work.

Nothing in this clause grants Participants ownership of Pratica's intellectual property.


33. Confidential Information

Participants acknowledge that the Program may include Confidential Information relating to Pratica's program, educational methodology and architectural workplace practice.

Participants agree to keep all Confidential Information strictly confidential during and after completion of the Program.

Without limitation, Participants must not disclose, publish, copy or distribute:

(a) project documentation;

(b) architectural drawings;

(c) design methodologies;

(d) workflow systems;

(e) consultant coordination procedures;

(f) office processes;

(g) internal quality assurance procedures;

(h) teaching resources;

(i) recorded mentoring sessions;

(j) business strategies;

(k) commercial information; or

(l) any information identified by Pratica as confidential.

This obligation survives completion or termination of the Program.


34. Use of Project Examples

The Program may include project examples, sample documentation and case studies based upon completed, historical, conceptual or simulated architectural projects.

Such examples are presented solely for educational purposes.

Participants acknowledge that:

(a) project examples may have been simplified to assist learning;

(b) project documentation may not represent the complete documentation package for a particular project;

(c) examples should not be copied directly for statutory approval or construction purposes;

(d) project examples remain the intellectual property of Pratica or their respective owners.

Participants must not reproduce, distribute or commercially use such project examples without written permission.


35. Australian Standards and Reference Documents

The Program may refer to Australian Standards, the National Construction Code, planning instruments, government publications and other reference materials.

Participants acknowledge that such materials remain subject to their respective copyright owners and licensing arrangements.

Unless expressly permitted by law, Participants must not reproduce or distribute Australian Standards or other copyrighted reference documents obtained through the Program.

Participants remain responsible for ensuring they consult the most current versions applicable to any professional work.


 

36. Artificial Intelligence

Pratica may introduce Participants to artificial intelligence ("AI") tools that may assist architectural workflows.

Any AI-generated content demonstrated during the Program is provided for educational purposes only.

Participants acknowledge that AI-generated outputs may contain inaccuracies, omissions or content unsuitable for professional use.

Participants remain solely responsible for reviewing, verifying and exercising professional judgement before relying upon any AI-assisted output.

Nothing in the Program encourages Participants to substitute professional judgement with AI-generated content.


37. Testimonials, Student Work and Promotional Material

Pratica may invite Participants to provide testimonials, feedback or examples of completed work for promotional purposes.

Pratica will not publish a Participant's testimonial, photograph or identifiable work for marketing purposes without that Participant's prior consent.

Where consent is provided, the Participant grants Pratica a non-exclusive, royalty-free licence to reproduce the approved testimonial or work for promotional, educational or marketing purposes.

A Participant may withdraw this consent at any time by providing written notice to Pratica. Such withdrawal will apply prospectively and will not require Pratica to recall or remove material already published in printed publications or marketing campaigns completed prior to receiving the withdrawal notice.


PART 4 – PARTICIPANT CONDUCT, LIABILITY AND GENERAL LEGAL PROVISIONS


38. Code of Conduct

Pratica is committed to providing a professional, respectful and collaborative learning environment that reflects the standards expected within the architectural profession.

Participants are expected to conduct themselves professionally throughout the Program and to contribute positively to the learning experience of all Participants.

Without limitation, Participants must:

(a) treat Mentors, presenters, guest speakers and fellow Participants with courtesy and respect;

(b) communicate in a professional and constructive manner;

(c) actively participate in learning activities where reasonably required;

(d) respect differing professional opinions during design reviews and discussions;

(e) submit work that honestly represents their own understanding and effort;

(f) comply with all reasonable directions given by Pratica or its authorised representatives;

(g) respect the confidentiality obligations contained within these Terms;

(h) use Program resources responsibly; and

(i) refrain from any conduct that may damage the reputation of Pratica or materially disrupt the learning environment.

Pratica encourages open discussion and professional critique. Participants acknowledge that constructive feedback forms an integral part of architectural education and professional development.


39. Prohibited Conduct

Participants must not engage in conduct that is unlawful, abusive or inconsistent with the objectives of the Program.

Without limitation, Participants must not:

(a) harass, intimidate or bully another Participant, Mentor or representative of Pratica;

(b) engage in discrimination, vilification or offensive behaviour on the basis of any characteristic protected by applicable Australian law;

(c) impersonate another person;

(d) provide false or misleading information during enrolment or participation;

(e) intentionally disrupt workshops or mentoring sessions;

(f) misuse online learning platforms;

(g) upload malicious software or otherwise interfere with Pratica's digital systems;

(h) use the Program to advertise or promote unrelated businesses or services without prior written approval;

(i) share another Participant's personal information without consent;

(j) engage in plagiarism or knowingly present another person's work as their own; or

(k) otherwise engage in conduct that Pratica reasonably considers inappropriate or detrimental to the learning environment.


40. Online Learning Community

Where Pratica provides access to online discussion groups, learning platforms, messaging channels or other community forums, Participants acknowledge that such platforms are intended solely to support learning and professional networking within the Program.

Participants agree to use these platforms responsibly and in accordance with these Terms.

Pratica reserves the right to moderate discussions, remove inappropriate content and suspend or remove Participants from any community platform where reasonably necessary to protect the integrity of the learning environment.

Removal from an online community does not automatically terminate the Participant's enrolment unless otherwise determined by Pratica.


41. Suspension and Termination

Pratica may suspend or terminate a Participant's enrolment where the Participant:

(a) materially breaches these Terms;

(b) repeatedly fails to comply with reasonable directions issued by Pratica;

(c) infringes Pratica's intellectual property rights;

(d) seriously disrupts the learning environment;

(e) engages in unlawful conduct;

(f) fails to pay Program Fees in accordance with these Terms;

(g) misuses confidential information obtained through the Program; or

(h) engages in conduct that may expose Pratica or other Participants to legal, reputational or operational risk.

Where reasonably practicable, Pratica will notify the Participant of the reason for the suspension or termination and, where appropriate, provide the Participant with a reasonable opportunity to respond or remedy the breach.

Nothing in this clause limits Pratica's right to immediately terminate enrolment where the seriousness of the conduct reasonably warrants immediate action.

Termination under this clause does not affect any accrued rights or obligations of either party.

Unless required by the Australian Consumer Law, termination for breach of these Terms does not entitle the Participant to a refund.


42. Health and Safety

Where any component of the Program is delivered in person, Pratica is committed to providing, so far as is reasonably practicable, a safe learning environment consistent with its obligations under the Work Health and Safety Act 2011 (NSW).

Participants must:

(a) comply with all reasonable health and safety instructions;

(b) behave in a manner that does not endanger themselves or others;

(c) immediately report any safety concerns to Pratica; and

(d) comply with any venue-specific safety requirements.

Participants acknowledge that they also have responsibilities under applicable work health and safety legislation to take reasonable care for their own health and safety and that of other persons.


43. Privacy

Pratica collects, stores and uses personal information for the purposes of administering the Program, communicating with Participants, providing educational services and complying with legal obligations.

Pratica will handle personal information in accordance with its Privacy Policy and, where applicable, the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

Personal information may include:

(a) contact details;

(b) enrolment information;

(c) payment information;

(d) attendance records;

(e) assessment submissions;

(f) communications relating to the Program.

Pratica will not disclose personal information except:

(a) with the Participant's consent;

(b) where reasonably necessary to deliver the Program;

(c) where required or authorised by law; or

(d) as otherwise described in Pratica's Privacy Policy.


44. Disclaimer and Limitation of Liability

To the maximum extent permitted by law, Pratica excludes all representations, warranties and conditions not expressly contained within these Terms.

The Participant acknowledges that participation in the Program is undertaken voluntarily.

While Pratica makes reasonable efforts to provide accurate and current educational content, it does not warrant that:

(a) all information will remain current following completion of the Program;

(b) all examples will be suitable for every project;

(c) the Program will meet every Participant's individual expectations; or

(d) participation will result in any specific educational, professional or employment outcome.

To the extent permitted by law, Pratica shall not be liable for any indirect, consequential or economic loss arising from participation in the Program, including loss of income, loss of opportunity, loss of employment prospects, business interruption or reputational damage.

Nothing in these Terms excludes any liability that cannot lawfully be excluded under the Competition and Consumer Act 2010 (Cth) or other applicable legislation.


45. Indemnity

To the extent permitted by law, the Participant indemnifies Pratica against any loss, damage, liability, cost or expense reasonably incurred by Pratica arising from:

(a) the Participant's breach of these Terms;

(b) infringement of Pratica's intellectual property rights;

(c) unlawful or negligent conduct by the Participant; or

(d) unauthorised use or distribution of Pratica's Training Materials.

This indemnity does not apply to the extent that any loss results from Pratica's own negligence, unlawful conduct or breach of these Terms.


46. Force Majeure

Pratica will not be liable for any delay or failure to perform its obligations under these Terms where such delay or failure results from events beyond its reasonable control.

Such events may include, without limitation:

(a) natural disasters;

(b) severe weather events;

(c) pandemics or public health emergencies;

(d) government restrictions;

(e) industrial disputes;

(f) failure of telecommunications services;

(g) widespread internet outages;

(h) cyber security incidents;

(i) venue closures; or

(j) any other event beyond Pratica's reasonable control.

Where reasonably practicable, Pratica will make reasonable efforts to resume delivery of the Program or provide an alternative method of delivery.


47. Dispute Resolution

If a dispute arises in connection with these Terms or the Program, the parties agree to first attempt to resolve the dispute through good faith discussions.

If the dispute is not resolved within twenty-one (21) days after written notice of the dispute is given, either party may pursue any rights or remedies available under applicable law.

Nothing in this clause prevents either party from seeking urgent interlocutory or equitable relief from a court of competent jurisdiction.


48. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

The parties submit to the non-exclusive jurisdiction of the courts of New South Wales and any court competent to hear appeals from those courts.


49. Severability

If any provision of these Terms is found to be invalid, illegal or unenforceable by a court of competent jurisdiction, that provision shall be severed to the extent necessary, and the remaining provisions shall continue in full force and effect.


50. Waiver

A failure or delay by Pratica in exercising any right under these Terms does not constitute a waiver of that right.

Any waiver must be in writing and signed by Pratica.

A waiver of one breach does not constitute a waiver of any subsequent breach.


51. Entire Agreement

These Terms, together with any documents expressly incorporated by reference, constitute the entire agreement between Pratica and the Participant concerning the Program.

They supersede all prior discussions, representations, understandings and agreements relating to the Program to the extent permitted by law.

Participants acknowledge that they have not relied upon any representation or statement that is not expressly contained within these Terms, except where such reliance cannot lawfully be excluded under the Australian Consumer Law.


52. Amendments

Pratica may amend these Terms from time to time where reasonably necessary to reflect changes in legislation, business operations, educational practices or the delivery of the Program.

Updated Terms will be published on Pratica's Website or otherwise provided to Participants.

Amendments will apply to future enrolments immediately upon publication.

Where an amendment materially affects existing Participants during an active Program, Pratica will provide reasonable notice before the amendment takes effect.

Nothing in this clause affects any rights that Participants may have under applicable law.


53. Notices

Any notice required to be given under these Terms must be given in writing.

Pratica may provide notices by:

(a) email;

(b) the online learning platform;

(c) the Participant's registered account; or

(d) any other electronic communication method reasonably notified to Participants.

Participants are responsible for ensuring that their contact details remain current.

A notice is deemed received:

(a) if sent by email, when the email leaves the sender's information system unless the sender receives notification that delivery has failed;

(b) if posted on the Participant's online account or learning platform, when it becomes accessible to the Participant.
